The Six Laws Every Sacramento Homeowner Should Know
1. California Solar Rights Act, Civil Code 5714
HOAs cannot prohibit residential solar installations or impose restrictions that significantly raise cost or lower performance.
Civil Code 5714 is the cornerstone of California solar rights. It voids any HOA covenant, restriction, or guideline that bans solar outright or that adds more than $1,000 in cost or reduces output by more than 10%. An HOA architectural committee can require aesthetic specifications (color, location on the roof) as long as those rules do not push past those thresholds. In Sacramento, the practical pattern is: HOAs ask for all-black panels and low-profile mounting, we comply on the original spec, approval lands in 30 to 45 days.
2. Solar Shade Control Act, Public Resources Code 25980-25986
Can my Sacramento HOA stop me from installing solar?
No. California Civil Code 5714 (the Solar Rights Act) prohibits HOAs from imposing restrictions that significantly increase cost or decrease performance of a solar system. Sacramento has minimal HOA pushback citywide. A few newer subdivisions (parts of Natomas, Greenbriar, parts of Curtis Park master-planned additions) have architectural review but most Sacramento neighborhoods are standard SMUD (or PG&E at the edges) permit-and-go. Civil Code 5714 covers the exceptions cleanly.
What is the Solar Shade Control Act in Sacramento?
California Public Resources Code 25980-25986 (the Solar Shade Control Act) limits a neighbor's right to plant trees that shade your existing solar system. The protection applies only to trees planted after your solar was installed and only to the area between 10am and 2pm. It does not retroactively protect against trees that were already there.
Do I have a right to interconnect my solar system to SMUD?
Yes. California Public Utilities Code 2851 establishes the right of residential and small-commercial customers to interconnect.
